Terms of Use for Lodging

These terms of use apply to your use of the Lodging electronic website and platform, as well as the services provided through it. Your use of the website constitutes your agreement to these terms, including the policies referenced herein. If you do not accept the terms of use, you must refrain from using the website or its services.

The following definitions apply to the terms of use:

- "Lodging" refers to Lodging Collective, an Emirati company registered in Dubai under number 1186255.

- "The website" refers to the websites and applications owned by Lodging.

The terms of use include various policies, including the ones mentioned below. These policies may apply to specific services or programs provided by Lodging.

We may amend the terms of use from time to time and publish them on the website.

The terms of use constitute the entire agreement between you and Lodging, replacing any previous agreements or understandings.

 

  1. Services Provided by Lodging

Facilitating Reservations:

 

Lodging offers an electronic platform for showcasing various types of temporary accommodation units, such as cottages, inns, holiday homes, chalets, farms, campsites, cabins, yachts, and more (collectively referred to as "Accommodations"). The platform also provides the option to make reservations for these Accommodations and make payment in advance using credit cards, debit cards, digital wallets, or other payment methods for payment facilitation (referred to as "Payment Methods"). By making a reservation for an Accommodation through the website, you are making an offer to book at the listed price for that reservation, subject to the terms and conditions specified on the website. This becomes a binding contract under the terms of use when accepted by the Accommodation. You will receive a confirmed Accommodation reservation confirmation via email and/or text message, indicating that the reservation has been confirmed by the Accommodation. Confirmation of the reservation via email means that the reservation request has been received and processed, and you do not need to take any further action. We reserve the right to reject reservations as specified below.

When providing our services, the information we present about accommodations is based on data provided to us by our suppliers or service providers affiliated with us, including accommodations, their representatives, agents, destination management companies, booking channel managers, partners, and others. Therefore, accommodations or their representatives bear full responsibility for updating all prices, availability data, descriptions, images, booking terms, accommodation policies, and other information displayed on the website. Despite our reasonable efforts to review and verify the performance of our services, we do not guarantee that all information is accurate, complete, truthful, or up-to-date. Additionally, we do not assume any responsibility for any errors (including typographical or clerical errors), interruptions (whether caused by any malfunction, temporary and/or partial, repair, upgrade, maintenance of the website, or otherwise), inaccurate, misleading, or incorrect information, or the non-provision of information in its entirety. Each accommodation is responsible at all times for the accuracy, completeness, and truthfulness of the information displayed on the website. Changes in market conditions or circumstances may occur within a short period, which may render the information displayed on the website inaccurate or outdated. In the event of any issues, our customer service team will make reasonable commercial efforts to assist you and act as a point of contact with the accommodation. Please note that Lodging is one of the accommodation channels used to make accommodations available for booking. When search results indicate that a specific accommodation is not available, this means that this type of accommodation is not available for booking through Lodging.

The website does not constitute, and should not be considered, a recommendation or endorsement of the quality, service level, or rating of any listed accommodation. Accordingly, we disclaim any warranties, representations, or guarantees regarding the quality, condition, or suitability of any accommodation listed on the website. In cases where "Featured Partners" are available, selected accommodations will have the opportunity to enhance their listing on the website. These accommodations will be marked to indicate their affiliation with the Featured Partners program.

We reserve the right, at our discretion, to reject or cancel bookings in exceptional cases, and we will notify you of the rejection or cancellation via email to the provided address or through a text message to our registered phone number. The reasons for rejection or cancellation may include the following:

Cancellation by the Accommodation: Re-selling pre-booked accommodations (or suspicion thereof) through the website to an individual or group without obtaining written approval from us (referred to as "Re-selling"). Violation of the terms of use or the occurrence of force majeure circumstances, commercial or economic sanctions, legal prohibitions or restrictions, or suspicions of fraudulent activity, theft, or engaging in criminal activities, suspicious reservations, providing misleading or incorrect information by the customer, payment issues, unacceptable behavior, threats, insults, violence, refusal to provide information, operational obstacles, communication problems, gross errors (see below), prior history of the customer, or bans imposed by governments or international organizations, and so on. In the event of booking rejection or cancellation by Lodging, and if the amount has already been paid, the total booking value will be refunded (excluding unauthorized Re-selling or any other appropriate case, such as unauthorized website use or inappropriate website usage that has caused harm to us where the refund of the total booking value or any portion of it cannot be justified). Refunds will not be transferred in cases of unauthorized Re-selling due to significant negative consequences. This may include placing the previously sold accommodation on competing Lodging websites without Lodging's knowledge. We also reserve the right to temporarily or permanently prohibit ("ban") users from using the website, at our discretion. Banned users must not attempt to use the website under another name or through another user.

In rare cases, we may also cancel or reject a booking due to "gross errors," regardless of the origin of those errors. For clarification purposes, a gross error is a website error (e.g., price terms, general terms, points, etc.) that a reasonable person would not consider as normal. If your booking is affected by a clear error, we will notify you via email at the address provided during the booking process, and we will adjust the booking as necessary, refunding either a portion or the entire deducted amount, as applicable.

 

2. Lodging Terms of Use.

 

We grant you a limited, restricted, personal, non-transferable, and revocable license to access and use the website only as expressly permitted in the Terms of Use. Except for this limited license, we do not grant you any other rights or licenses with respect to the website, and we reserve all rights and licenses not expressly granted. The content and information on the website, as well as the software and infrastructure used to provide that content and information, are the exclusive property of Lodging, its suppliers, or its affiliated service providers, including accommodations and additional services. You may only use the website for inquiries or reservations in good faith, and you hereby undertake not to make speculative, false, fraudulent, or requests for reservations. You also undertake that the payment details you provide to us when making any reservation are entirely accurate. Furthermore, you agree to provide a valid email address, postal address, and other contact information to Lodging and acknowledge that Lodging may use such data to contact you if necessary.

Accordingly, as a condition of using the website, you agree not to use the website or its content or information for any commercial or non-personal purpose (directly or indirectly) or for any unlawful or unauthorized purpose under the Terms of Use. You also agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or resell any information, software, products, or services obtained from the website without our prior written consent. Additionally, you agree not to:

a. Use the website or its contents for any commercial purpose that is unauthorized, including examples such as distributing or reselling reservations without permission.

b. Make any speculative, false, or fraudulent reservations.

c. Access or monitor any content or information on the website or copy it using automated software, spiders, scrapers, or other automated means, or any manual process for any purpose without our prior express written permission.

d. Violate the restrictions in any robot exclusion headers on the website, bypass, or circumvent other measures employed to prevent or limit access to the website.

e. Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.

f- Creating deep links to any section of the website for any purpose without obtaining explicit prior written permission from us.

g- Reselling, using, copying, monitoring (through spider or scraper programs), displaying, downloading, or reproducing any content, information, software, products, or services available on the website for any commercial or competitive activity.

h- "Scraping" or "simulating" or otherwise incorporating any part of the website into any other website without our prior written permission.

i- Posting any unlawful messages (according to any and all applicable regulations and laws) on or through the website or any messages that may support unlawful activity.

j- Posting or placing links to messages containing materials that may be harmful, obscene, indecent, lewd, violent, abusive, offensive, defamatory, racist, discriminatory, harassing, hateful, or otherwise objectionable or offensive in any way.

k- Posting, or placing links to, messages that contain defamatory, slanderous, false, or libelous materials.

l- Posting any messages that violate or infringe upon the intellectual property rights or other rights of any party or individual, including, for example, copyright, patents, trademarks, trade secrets, privacy rights, or publicity rights.

m- Posting any messages that you are not legally entitled to make available under any contractual or agency relationship or any messages that impersonate another person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity with the intent to deceive, defraud, or mislead another person.

n- Manipulating identifiers, including by forging message headers, in order to conceal the origin of any message you post.

o- Using the website in any manner that may cause damage, disruption, overload, impairment, or interference with the use of the website or the computers, devices, or networks of other users, or cause any harm or limitation to the functionality of any software, device, or communication equipment.

p- Attempting to gain unauthorized access to the website, any related website, or other accounts, computer systems, or networks connected to the website through hacking, password mining, or any other means.

q- Collecting or attempting to collect any materials or information through any means not intentionally made available through the website, including without limitation information about others such as email addresses.

r- Engaging in any fraudulent practices intended to manipulate search engine results pages or using search engine optimization ("SEO") methods that are generally unacceptable for search engines. Unethical SEO practices, also known as "black hat" practices (also known as "index cheating"), may include, for example, identity hiding, login data and identifiers, content scraping, link schemes, Google bombs, keyword stuffing, hidden text and links, doorway pages, and comment spamming, among others.

s- Engaging in any other activity that may cause damage to the website, related Lodging companies, their employees, or the reputation of Lodging, or have any other negative impact otherwise.

u- Assisting or inciting any of the above.

v- Unless expressly allowed otherwise, websites may not be linked to any page other than the website's home page or duplicated, or any webpage or content therein, and no entity may link to any aspect of the website for commercial purposes without obtaining our prior written permission.

w- By making a reservation on the website, you warrant and represent that you are not subject to any international punitive program.

x- If necessary, you must settle all your obligations and be unblocked or as required by your country of residence.

Y- Lodging may use proprietary or third-party-owned proprietary technology on its website pages to maintain site security against malicious attacks or any misuse of the site.

 

3. Pricing Policy

 

The pricing policy followed by Lodging to ensure the best rates, taxes, fees, and currency exchange rates on Lodging.

Please note that all prices on the website are for accommodation rates only unless stated otherwise. Without prejudice to the following, Lodging will display the accommodation rate only, excluding any security deposit, taxes, or any other fees, if applicable, before confirming the booking.

b. We strive to provide the most competitive rates and aim to pay the lowest possible price for your stay. If you find that your accommodation reservation, under the same booking conditions, is available online at a lower price after you have booked with Lodging, please inform us via email.

c. Additional Charges by Accommodations

d. In addition to booking rates, some accommodations may impose mandatory service charges, such as local taxes, insurance, or any other fees. We may inform you of any additional fees through the website if applicable. Insurance or local taxes may be collected directly from you by the accommodation provider in addition to the price you pay for your reservation.

e. Additional costs will be incurred at the accommodation for all services and products you use, which are not included in the booking price unless expressly stated in the booking terms. Facility fees that you use and products you consume during your stay (e.g., parking, internet access, food, beverages, or events) are not included in the booking price unless stated otherwise.

Note: The final price charged to you is in the payment currency specified by the accommodation, taking into account international exchange rates at the time of the transaction.

 

Summary of Fees:

 

The fees retained by Lodging are part of our service charges and cover the costs of your reservation, such as customer service and transfer fees.

Our accommodation suppliers, as service providers, may collect applicable taxes, insurance fees, or other charges at the accommodation. Lodging is not responsible for collecting any additional fees beyond the accommodation booking value.

In some locations, local laws may require accommodations to impose city, bed, tourist occupancy taxes, or equivalent taxes directly. Taxes and fees for additional services you may purchase could be detailed in our partner's terms and conditions.

 

4. Privacy Policy

5. Payment Terms

 

- Credit Card - "Book Now, Pay Later" - Age – Fraud.

When you make advance payments for your reservations with Lodging, it means you authorize Lodging to use and process your information - through external parties - in a way that allows us or the issuer of your payment methods (such as credit or debit card) to verify your identity. Personal information collected about you and shared with external parties (including your financial transactions and/or account maintenance) is included in our Privacy Policy.

To complete the payment for prepaid accommodation reservations with Lodging or related companies, you authorize lodging to deduct the full amount from the selected payment methods (sometimes without the option of a refund depending on the accommodation booking terms, please see below).

Lodging will process refunds, as necessary, within a reasonable timeframe. You also authorize the deposit into your payment method in case of refunds, settlements, or money returns to you or service modifications, facilitating financial transactions. For some accommodations, selected payment companies may impose a "foreign transaction processing fee" on their users. If your card transaction is in a different country than the issuer's country of your card - as well as the recipient's - additional fees such as international transaction fees or cross-border fees may be added. Your card issuer may or may not impose this fee. Please contact your card issuer for details, as this part is beyond Lodging's control.

In case of fraud by the selected payment method or its unauthorized use by others, you should contact your bank or card issuer immediately upon discovering such unauthorized use. If you suspect any unauthorized or fraudulent bookings through Lodging, please contact our customer service team immediately.

To make any reservation, you must be over 18 years of age (or the legal age in countries where the legal age is higher than 18) and have full legal capacity to complete the transaction (or have a legal guardian authorization). You warrant that your payment instrument is yours or that you are authorized to complete the booking using this payment instrument and that there are sufficient funds to cover the transaction cost. You accept financial responsibility for all transactions made under your name or account.

You also undertake that the payment details you provide to us when making any reservation are entirely accurate. Lodging reserves the right not to accept certain payment methods. Lodging may add or remove other payment methods at its discretion. Lodging may later offer the option to retain selected payment method details to facilitate future bookings within a confidential and secure file. If you choose to store your credit or debit card with Lodging, we may not request card verification or security code the next time you use it for a booking. For more details, please refer to our privacy policy.

We apply strict mechanisms to detect and prevent fraud. Therefore, we only accept instant payment without storing any payment information. The amount will be deducted immediately. Bookings are not confirmed unless you receive an electronic confirmation message with a booking voucher, and some accommodations or additional services may become fully booked during verification. In that case, the reservation will not be available. Lodging assumes no responsibility whatsoever in such cases. Information will be handled accordingly. In such cases, the reservation will be canceled as incomplete, and any amounts will be refunded in full.

 

A Word on Installments:

 

Lodging may support payments in installments ("Installments" or "Deferred Payments"). This service is not provided by Lodging but by an external party ("Installment Facilitator"). If you wish to pay in installments, you will need to agree to the terms and conditions of the installment payment structure with the Installment Facilitator and/or an additional agreement with Lodging, available on the Installment Facilitator's website. If you do not meet the requirements or do not comply with the terms and conditions of the installment program, installment payments will not be available to you. If you violate the terms and conditions of the Installment Facilitator, you will be subject to the consequences outlined in the Installment Facilitator's terms and conditions. Lodging reserves the right to cancel your reservation upon violation of the Installment Facilitator's terms and conditions. You agree to pay and are solely responsible for the full amount of the reservation and agree that Lodging has the right to collect the reservation amount due from you for the Installment Facilitator and/or its affiliates.

 

A Note on Failed Payments:

 

Payments on the website may not succeed for various reasons. In such cases, Lodging will provide you with alternatives, if available, to complete the booking. If you have any questions, please contact our customer service department.

 

6. Booking Terms, Cancellations, No-Shows, Early Departure, Late Check-Out, and Property-Specific Policies.

 

By making a reservation through our website, you accept and agree to the relevant accommodation booking terms, including the cancellation policies and no-show policies applicable to that reservation.

If you, as a guest, decide to cancel your reservation, the refund you will generally receive will be determined according to the cancellation policy in place on Lodging, as agreed upon with its partners and property owners, and as follows:

A nominal cancellation fee may be deducted (100%).

Less than seven (7) days and within 24 hours prior to the booking time.

A nominal cancellation fee may be deducted (50%).

Less than 24 hours prior to the booking time.

Refund Policy:

In case of cancellation by either the renter or the owner before 7 days, the full amount will be refunded minus a 8.9% transfer fee. If cancelled after 7 days, 50% will be refunded to both parties minus a 8.9% fee from the canceling party. If cancelled within 24 hours, the affected party will be refunded minus an 8.9% transfer fee.

 
 
 

Cancellation Policy:

The cancellation time is calculated from 12:00 PM on the same day as the booking date. For example, if the booking is canceled before 12:00 PM on the day before the booking date, 50% of the booking value will be refunded. If the booking is canceled after 12:00 PM on the day before the booking date, 0% of the booking value will be refunded.

Some accommodations offer free cancellation within less than seven days of the booking date as an additional feature provided to the guest. In this case, the accommodation's cancellation policy will apply to your reservation, so we recommend carefully reading the accommodation's cancellation policy before making a booking.

If the guest does not show up at the specified booking time at the accommodation, the full booking amount will be deducted. In case the guest cannot arrive within the specified time frame due to force majeure circumstances beyond their control, they must notify the accommodation, and the accommodation will consider adjusting or canceling the reservation or refunding the booking amount. Please review the general cancellation and no-show policies for each accommodation on the website, which can be found on the accommodation's information pages under "Booking Terms" or "Booking Policies" or similar headings, as well as the booking amount. Please note that you may be charged for cancellation according to the accommodation's specific cancellation and no-show policy. If you fail to check in at the accommodation at the specified time on the day of your booking and do not notify them, you may not be eligible for a refund based on the accommodation's terms and conditions.

Regardless of the accommodation's cancellation policy, lodging reserves the right to deduct any other fees incurred due to the cancellation, such as service fees, bank charges, administrative fees, etc.

Many accommodations have specific policies regarding children, accompanying guests, or pets. As mentioned above, it is strongly advised to check with customer service or the accommodation itself for their specific policies.

Special Needs: If you have special needs (e.g., wheelchair-accessible room), you must contact the accommodation to verify that these special needs can be accommodated. Please note that special requests are subject to availability, and Lodging does not guarantee their fulfillment. If the accommodation cannot meet your special needs, your booking may be subject to refund, cancellation, or modification as per the accommodation's applicable policy. If available, your special request will be confirmed upon arrival. Lodging will not be responsible for any damages or costs you may incur if the accommodation does not meet your special needs.

 

About Lodging Price Alerts:

 

You can subscribe to alerts with Lodging on our website. We will send you notifications for offers and prices when they change at the accommodation during the specified time on the website. The type of price alert you receive depends on the platform you use: via email when subscribing from the Lodging website or through the mobile app.

 

About Promotional Offers:

 

Lodging may occasionally offer promotional prices, vouchers, promotional codes, coupons, discounts, and special offers ("Promotional Offers"). Unless explicitly stated otherwise, Promotional Offers cannot be combined.

 

About Promotional Codes and Coupons:

 

A valid promotional code or coupon must be applied on the payment page to be applied to your booking.

Unless specified otherwise, promotional codes and coupons do not apply to local taxes, service fees, and additional charges.

Some accommodations may exclude promotional codes and coupons.

Unless specified otherwise, promotional codes and coupons are not transferrable, cumulative, and cannot be combined with other offers, rewards, or loyalty programs.

Promotional codes and coupons cannot be redeemed for cash, credit, or other products.

In case of reservation cancellation, the promotional code or coupon does not have cash or refund value.

Some promotional codes or coupons may be available only in specific regions or for residents of specific regions.

Lodging reserves the right to discontinue the use of promotional codes or coupons by users if they are considered to have misused them.

Lodging reserves the right to change the terms without prior notice.

In case of any dispute, Lodging's decision will be final.

 

 

7. Reviews, Other Correspondence, and User Content Rights - and Other Services.

 

When you complete a reservation, you agree to receive confirmation messages (such as email and/or SMS), as well as an email invitation to complete our guest review form, which we'll send to you after your stay at the accommodation. Please note that confirmation messages and electronic guest review invitations are transactional and are not part of newsletters or marketing communications, which you can unsubscribe from (see our Privacy Policy for more details). Regarding additional services, the partner providing these services may send you an invitation to review the services they've provided. Complete Lodging customer reviews (including any comments) may be uploaded onto relevant information pages on our website for the sole purpose of informing (future) customers on the (level of) service and quality of the accommodations. By submitting a review, you grant lodging full and perpetual, free, transferable, and irrevocable rights to all User Content, including your name. Lodging reserves the right to translate, edit, adjust, refuse, or remove reviews, at its sole discretion. By posting a review, you agree that the review content you write is accurate and non-misleading, that it does not violate any applicable laws or regulations, and that it will not violate any rights or cause harm to any individual or entity. You also agree that you own or otherwise control all of the rights to the User Content you post or distribute. You further agree that Lodging has the right to use such content in a manner it deems appropriate, including, for example, deleting, editing, modifying, rejecting, or refusing to post it. Lodging is not obligated to provide any compensation for the User Content you submit or the opportunity to edit, remove, or otherwise change such content once it has been submitted to Lodging.

 Lodging is not obligated to attribute authorship of the content to you, and you agree not to assert any moral rights in such content or take any action to prevent the use or exploitation of such content by Lodging or its sublicenses, successors, or assigns. If you choose to retain any and all moral rights, including rights of attribution and integrity, in the User Content, you hereby provide an irrevocable and perpetual waiver of any and all such rights in and to the User Content. You further agree that you will not use any personal data related to the User Content, or any derived works, promotions, or updates of it, for any other purpose. You relinquish all moral rights to Lodging and its sublicenses, successors, and assigns forever. You discharge Lodging and its sublicenses, successors, and assigns forever from any claims that you could otherwise assert against Lodging under any moral rights theory.

 

8. Complaints

 

You can submit complaints related to Lodging's services via email, and we will do our utmost to assist you. Please note that any complaints related to accommodations or additional services (policies, standards, service, facilities, decor, food, etc.) are matters concerning the property itself or the partner. Lodging will directly coordinate with the property or partner to try to find an acceptable solution for both parties, but we cannot guarantee satisfactory results. Complaints regarding additional services are governed by the terms and conditions provided by the partner responsible for these services.

 

9. Disclaimer of Warranties.

 

All content, including software, products, services, information, text, and related graphics provided on or made available through the website is provided to you on an "as-is" and "as-available" basis. Lodging makes no warranties or representations of any kind, express or implied, regarding the operation of this website or the information, content, or materials included on this website, and to the fullest extent permitted by applicable law, Lodging disclaims all warranties and conditions, including, but not limited to, express or implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or those arising by law, statute, usage of trade, or course of dealing. Lodging does not warrant or make any representations concerning the availability, accuracy, completeness, reliability, or timeliness of any materials included on this website, including, for example, information, content, or related graphics.

Lodging does not warrant or represent that the website will operate without errors or interruptions, that defects will be corrected, or that the website and/or its servers will be free from viruses and/or other harmful components. Lodging also does not warrant or make any representations regarding the sustainability, availability, accuracy, reliability, completeness, or timeliness of any materials of any kind included on the website, including software, products, services, information, text, and related graphic content.

Unless Lodging is responsible for willful misconduct or gross negligence, Lodging shall not be liable for any failures resulting from server crashes, misleading transfers, misdirected redirections, internet communication interruptions, booking send/receive failures, or any computer viruses or other technical defects, whether of human or technical nature.

The limitation or disclaimer of liability mentioned above may not be restricted or exempted according to applicable laws. In this case, Lodging shall be liable to the extent specified by relevant laws.

 

10. General Disclaimer of Liability.

 

Under the law, Lodging and related companies, including its employees, managers, staff, representatives, subsidiaries, affiliates, suppliers, licensors, agents, or any other entities involved in providing, endorsing, promoting, or making the website and its contents available, are not liable under any circumstances, to any person or entity, for any direct, indirect, incidental, special, consequential, punitive, exemplary, or any other damages or losses, including but not limited to:

a. Loss of production, loss of profits, loss of revenues, loss of contracts, loss or damage to reputation or brand image, loss of claims, business interruption, data losses, or other intangible losses.

b. Your inability to use or unauthorized use, delay, action, or inaction of the website.

c. Unauthorized access to or manipulation of personal information or transmitted data.

d. Provision or failure to provide any service, including services offered or products provided by the accommodation, cancellations (partial), or exceeding the reservations for the set capacity.

e. Errors or inaccurate data on the website, including, for example, information (descriptive) (such as prices, availability, ratings) regarding the accommodation available on the website, as well as related software, products, services, graphics, and any other relevant information.

f. Any transactions made through the website.

g. Any property damages, including damages to your computer or computer system resulting from viruses or other harmful elements during or as a result of accessing or using the website or any website linked through it.

h. Any other damages arising from the use of the website or any use or delay or inability to use the website or any information, products, or services obtained through the website.

i. Lodging and its related entities shall not be liable for any injuries (personal), death, property damages, or any other damages resulting from the actions of the accommodation (its employees, managers, staff, representatives, subsidiaries, affiliates).

This disclaimer of liability may not be limited or exempted according to applicable laws. In this case, Lodging shall be liable to the extent specified by relevant laws.
